PoSH Compliance Check List

  1. Policy & Awareness

✅ Draft and implement a clear PoSH policy covering definitions, reporting mechanisms, and consequences.
✅ Ensure the policy is communicated to all employees in a language they understand.
✅ Display the PoSH policy prominently at the workplace (both physical and digital spaces).
✅ Conduct PoSH awareness training for all employees at least once a year.
✅ Provide specialized training for managers and the Internal Committee (IC) members.

  1. Internal Committee (IC) Compliance

✅ Constitute an Internal Committee with at least four members, including:

  • A presiding officer (senior female employee).
  • At least two employee representatives.
  • An external member with expertise in women's rights or legal matters.
    ✅ Ensure the IC undergoes training on handling complaints and conducting inquiries.
    ✅ Define a clear process for filing and addressing complaints confidentially.
    ✅ Maintain records of all complaints, resolutions, and annual reports.
  1. Handling Complaints Effectively

✅ Provide multiple channels (email, online portal, grievance box) for employees to report sexual harassment complaints.
✅ Ensure prompt action by acknowledging complaints within 7 days.
✅ Offer the complainant an option for conciliation (if appropriate and agreed upon).
✅ Complete the IC investigation within 90 days and submit a report within 10 days.
✅ Take employer action within 60 days of receiving the IC report.
✅ Ensure strict confidentiality of complainants and proceedings.

  1. Employer’s Responsibilities

✅ Include PoSH compliance in employment contracts and workplace policies.
✅ Conduct periodic reviews of workplace safety and harassment policies.
✅ Submit an annual report on PoSH compliance to the District Officer.
✅ Ensure no retaliation against employees who file complaints in good faith.

  1. Regular Compliance Audits

✅ Perform internal audits to assess PoSH policy effectiveness.
✅ Gather employee feedback on workplace safety and harassment prevention.
✅ Update training programs and policies based on audit findings and legal updates.
